A High Court in Bauchi State has thrown out a lawsuit brought by Alhaji Hamza Koshe and his firm, Pentech Engineering Nig. Ltd, which sought to prevent the Economic and Financial Crimes Commission (EFCC) from conducting an investigation and pursuing legal action against them.

In a ruling issued on July 30, 2025, Justice Aliyu Baba Usman stated that courts do not have the authority to grant perpetual injunctions that would stop law enforcement agencies from fulfilling their constitutional responsibilities.
“The court cannot, through a perpetual order or any other method, prevent the EFCC or ICPC from executing their rightful duties of investigating and prosecuting cases of money laundering, corruption, economic and financial crimes, or any related offenses,” Justice Usman asserted.
Koshe approached the court on September 23, 2024, submitting a 31-paragraph affidavit, requesting an order to bar the EFCC, ICPC, or any of their representatives from probing issues connected to a contract financing agreement between the Bauchi State Ministry of Finance (Treasury Division) and his company.
Rather than responding to a previous EFCC invitation for questioning, Koshe opted to file the lawsuit to stop the investigation. However, the ruling now allows the EFCC to continue with its inquiry.
